This document contains both the Privacy Policy and the Terms of Service for Pretty House Team – Amanda Lebiszczak, led by Amanda Lebiszczak, Broker/Realtor® with Charles Rutenberg Realty (“The Pretty House Team,” “we,” “us,” or “our”), and applies to prettyhouseteam.com and all related pages, forms, property searches, email, and text-message communications (together, the “Services”).

By using our website or submitting your information to us, you agree to this Privacy Policy and the Terms of Service below. If you do not agree, please do not use the Services.

1. Notice at Collection (Summary)

This short summary is provided at or before the point of collection, as required by California law. The full details are in the Privacy Policy that follows.

• Identifiers — name, email address, phone number, postal or property address, IP address, account login. Why we collect it: To answer your inquiry, arrange showings, send listing and property updates, and provide real estate services. How long we keep it: For the length of our relationship plus the period required by Florida real estate recordkeeping rules and applicable law.
• Commercial and preference information — property searches, saved favorites, price range, timeline, home valuation requests. Why we collect it: To match you with properties and prepare market analyses. How long we keep it: Up to 3 years after your last activity.
• Internet and device activity — pages viewed, referring site, browser and device type, cookie data. Why we collect it: To operate, secure, and improve the website and measure our marketing. How long we keep it: Up to 26 months.
• Communications content — form messages, emails, and text messages you send us. Why we collect it: To respond to you and keep a record of the transaction. How long we keep it: For the length of our relationship plus applicable recordkeeping periods.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We never share mobile opt-in consent data or phone numbers with third parties or affiliates for marketing purposes. We do not knowingly collect personal information from anyone under 16.

2. Privacy Policy

2.1  Who we are

The Pretty House Team is a real estate team serving Palm Harbor, Dunedin, Safety Harbor, Tarpon Springs, Ozona, Clearwater, St. Petersburg, and the surrounding Florida Gulf Coast, operating under Charles Rutenberg Realty. Our business address and phone number are listed in the Contact Us section.

2.2  Information you give us directly

We collect the information you choose to provide through our contact forms, home valuation requests, property search registration, newsletter signups, phone calls, emails, and text messages. This may include:

• Your first and last name
• Email address
• Mobile and/or landline telephone number
• Mailing address and the address of a property you are buying, selling, or asking about
• Whether you are a buyer, seller, or both, and your preferred contact method
• Property preferences — price range, location, bedrooms, waterfront or golf community, timeline to move
• Financing information you volunteer, such as whether you are pre-approved, paying cash, or working with a lender
• Account credentials if you register to save favorite properties or searches
• The content of any message, question, or document you send us

Providing this information is voluntary, but some of it is necessary for us to answer your question or represent you in a transaction.

2.3  Information collected automatically

When you visit our website, we and our service providers may automatically collect:

• IP address and general location derived from it (city or region level)
• Browser type, operating system, device type, and screen size
• Pages viewed, listings viewed, links clicked, time on page, and the site or ad that referred you
• Date and time of your visit and other server log data
• Cookie and similar identifiers, as described in Section 2.6

2.4  Information from other sources

We may receive information about you from:

• Multiple Listing Service (MLS) and IDX listing feeds that power our property search
• Charles Rutenberg Realty and other real estate brokerages, agents, and referral partners
• Third-party lead and advertising platforms where you submitted an inquiry about us or our listings
• Public records, including county property appraiser and clerk of court records
• Service providers who help us verify information, prevent fraud, or manage our marketing

2.5  How we use your information

• To respond to your inquiry and provide the real estate services you request
• To schedule and confirm showings, appointments, inspections, and closings
• To send listing alerts, property updates, market reports, and follow-up messages
• To prepare home valuations and comparative market analyses
• To create and manage your account and saved searches or favorites
• To negotiate, document, and complete a real estate transaction, including coordinating with your lender, title company, inspector, appraiser, or attorney at your direction
• To send newsletters, market updates, and promotional messages where permitted, which you may unsubscribe from at any time
• To operate, secure, troubleshoot, and improve the website and measure the performance of our advertising
• To comply with legal, regulatory, brokerage, and real estate licensing obligations, including recordkeeping requirements, and to establish or defend legal claims
• To detect and prevent fraud, wire fraud attempts, spam, and abuse of the Services

2.6  Cookies, tracking, and your choices

Our website uses cookies and similar technologies to keep you logged in, remember your saved properties and searches, understand how visitors use the site, and measure our marketing. You can block or delete cookies through your browser settings, but some features of the site — including saved favorites and property search — may not work correctly if you do.

Do Not Track. Some browsers transmit a “Do Not Track” (DNT) signal. There is no industry-standard response to DNT signals, and our website does not currently respond to them. We do honor the Global Privacy Control (GPC) signal as a valid request to opt out of the sale or sharing of personal information where applicable law requires it.

2.7  How we share your information

We do not sell or rent your personal information. We share it only as described here:

• Our brokerage. Charles Rutenberg Realty, as the licensed broker responsible for our real estate activity.
• Transaction participants, at your direction. Cooperating agents and brokers, title and escrow companies, lenders, inspectors, appraisers, surveyors, insurers, contractors, attorneys, and closing agents involved in your transaction.
• Service providers. Vendors who work on our behalf under contract, such as our website host and developer, CRM, email marketing platform, text-messaging provider, IDX/MLS technology vendor, e-signature service, scheduling tools, and analytics providers. They may use your information only to perform services for us.
• MLS and real estate data services, where required by our MLS participation rules for listings and transaction reporting.
• Legal and safety reasons. When required by law, subpoena, court order, or government request, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others, or to investigate fraud.
• Business transfers. In connection with a merger, sale, or transfer of all or part of our business, subject to this Privacy Policy.

Mobile opt-in data is never shared. See the SMS Terms & Privacy Policy in Section 3.

2.8  Data retention

We keep your personal information for as long as needed to provide the Services, maintain our business records, and comply with legal, tax, brokerage, and real estate licensing recordkeeping obligations. Transaction records are generally retained for at least 5 years. When information is no longer needed, we delete it or de-identify it.

2.9  Security

We use reasonable administrative, technical, and physical safeguards designed to protect the information we hold, including encrypted connections on our website and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Wire fraud warning. We will never send you wiring instructions or request funds by email or text. If you receive any communication that appears to come from us asking you to wire money or change wiring instructions, do not act on it. Call our office directly at the number listed in Contact Us to verify.

2.10  Children’s privacy

The Services are intended for adults. We do not knowingly collect personal information from children under 13, and we do not knowingly sell or share the personal information of consumers under 16. If you believe a child has provided us with personal information, please contact us and we will delete it.

2.11  Third-party links

Our website links to third-party sites and services, including MLS and IDX search tools, social media, mortgage calculators, and review platforms. We are not responsible for the privacy practices or content of those sites. Please review their privacy policies before providing information.

2.12  Changes to this Privacy Policy

We may update this Privacy Policy from time to time. The “Last updated” date at the top of this document reflects the most recent version. Material changes will be posted on this page, and your continued use of the Services after posting constitutes acceptance of the updated policy.

3. SMS Terms & Privacy Policy

The Pretty House Team sends SMS/text messages to customers who opt in, including appointment reminders, listing and property updates, showing confirmations, and follow-ups.

Message frequency varies. Message and data rates may apply.

Reply STOP at any time to cancel. After you send STOP, you will no longer receive text messages from us. Reply HELP for help, or contact us at amanda@prettyhouseteam.com or (727) 655-9324.

Carriers are not liable for delayed or undelivered messages.

We do not share mobile opt-in consent data or phone numbers with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the Text Message services.

3.1  How you opt in

You may opt in to receive text messages from us by:

• Checking the SMS consent box on a form on our website
• Providing your mobile number and agreeing to receive texts during a phone call, in person, or in writing
• Texting us first from your mobile number

Consent to receive marketing or promotional text messages is not a condition of purchasing any property, product, or service from us. You may still work with us by phone or email if you prefer not to receive text messages.

3.2  Supported carriers and delivery

Text messaging is supported on major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages, and message delivery is subject to effective transmission by your wireless carrier.

3.3  Opting out and getting help

• STOP — Reply STOP to any message to cancel. You will receive one final message confirming that you have been unsubscribed, and you will receive no further text messages from us unless you opt in again.
• HELP — Reply HELP for assistance, or contact us using the information in Section 7.
• Opting out of text messages does not opt you out of email or phone communications. To stop those, use the unsubscribe link in our emails or contact us directly.

3.4  Privacy of your mobile information

Your mobile phone number and your consent to receive text messages are used only to send you the messages described above. We do not sell, rent, or share your mobile number or opt-in consent data with third parties or affiliates for their marketing or promotional purposes. The only parties with access to this data are the messaging aggregators and service providers that deliver the messages on our behalf, and they may use it only for that purpose.

4. Your California Privacy Rights (CCPA/CPRA)

This section applies to California residents and is provided under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”), the California Online Privacy Protection Act (“CalOPPA”), and California Civil Code § 1798.83 (“Shine the Light”). We provide these rights to California residents regardless of whether we are legally required to do so.

4.1  Categories of personal information we collect

In the past 12 months, we have collected the following statutory categories of personal information:

• Identifiers. Name, postal address, email address, telephone number, IP address, account name. Sources: You; our website; lead platforms; public records. Disclosed for a business purpose to: Our brokerage; service providers; transaction participants at your direction.
• Customer records (Cal. Civ. Code § 1798.80). Name, address, telephone number, and financial details you volunteer such as pre-approval status. Sources: You; your lender or agent at your direction. Disclosed for a business purpose to: Our brokerage; lenders, title, and closing agents at your direction.
• Commercial information. Properties viewed, saved, or inquired about; valuation requests; transaction history. Sources: You; our website and IDX search. Disclosed for a business purpose to: Service providers; MLS where required.
• Internet or network activity. Browsing and search history on our site, interaction with listings and ads. Sources: Automatically, via cookies and server logs. Disclosed for a business purpose to: Analytics and hosting service providers.
• Geolocation data. Approximate city- or region-level location derived from IP address. Sources: Automatically. Disclosed for a business purpose to: Analytics and hosting service providers.
• Inferences. Preferences and characteristics such as likely price range, preferred areas, and buying or selling timeline. Sources: Derived from the categories above. Disclosed for a business purpose to: Service providers.

We collect this information for the business and commercial purposes described in Section 2.5, and we retain it for the periods described in Sections 1 and 2.8.

4.2  Sensitive personal information

We do not collect or process sensitive personal information for the purpose of inferring characteristics about you. If you choose to provide sensitive information — for example, financial account details in connection with a transaction — we use it only to perform the services you requested and for purposes permitted without a right to limit under the CCPA. We do not sell or share sensitive personal information.

4.3  Sale and sharing

We do not sell personal information, and we do not share personal information for cross-context behavioral advertising. We have not sold or shared the personal information of consumers under 16 years of age, and we do not knowingly do so.

4.4  Your rights

Subject to verification and legal exceptions, California residents have the right to:

• Know and access the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties to whom we disclose it
• Delete the personal information we collected from you
• Correct inaccurate personal information we maintain about you
• Opt out of the sale or sharing of personal information (we do not sell or share, but you may still submit a request)
• Limit the use and disclosure of sensitive personal information
• Not be discriminated or retaliated against for exercising any of these rights — we will not deny you services, charge different prices, or provide a lower quality of service because you exercised your privacy rights

4.5  How to submit a request

You or your authorized agent may submit a request using any method in Section 7, or by writing to us at 1545 Belcher Road, Clearwater, FL 33764 or calling (727) 655-9324.

To protect your information, we will ask you to verify your identity by confirming information we already have on file, such as the email address or phone number you used to contact us. If an authorized agent submits a request on your behalf, we may ask for proof of written authorization and may ask you to verify your identity directly.

We will confirm receipt of your request within 10 business days and respond within 45 calendar days. If we need more time, we will notify you and may take up to an additional 45 days. There is no fee to submit a request unless it is excessive, repetitive, or manifestly unfounded.

4.6  Shine the Light

California Civil Code § 1798.83 permits California residents to request information about the personal information we disclosed to third parties for their own direct marketing purposes in the preceding calendar year. We do not disclose personal information to third parties for their direct marketing purposes. To submit a Shine the Light request, contact us using the information in Section 7.

4.7  CalOPPA

Registered users may review and change the personal information in their account at any time by logging in to their account on our website, or by contacting us and asking us to make the change on their behalf. Our response to Do Not Track signals is described in Section 2.6.

5. Other State Privacy Rights

Residents of Florida, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other states with comprehensive privacy laws may have rights to access, correct, delete, or obtain a portable copy of their personal information, and to opt out of targeted advertising, the sale of personal information, and certain profiling. To exercise any of these rights, contact us using the information below and tell us which state you reside in. If we deny your request, you may appeal by replying to our response; we will inform you of the outcome within the time required by your state’s law and tell you how to contact your state Attorney General if you disagree.

6. Terms of Service

6.1  Acceptance of these terms

By accessing or using the Services, you agree to be bound by these Terms of Service and by the Privacy Policy above. If you do not agree, do not use the Services. We may update these Terms at any time by posting a revised version on this page. Your continued use of the Services after we post changes means you accept them.

6.2  Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services.

6.3  No brokerage relationship created

Using this website, submitting a form, or receiving information from us does not create a brokerage relationship, agency relationship, or fiduciary duty between you and The Pretty House Team or Charles Rutenberg Realty. A brokerage relationship is created only by a signed written agreement. Nothing on this website is legal, tax, financial, appraisal, engineering, or investment advice. Consult your own attorney, accountant, lender, inspector, or other licensed professional before making a real estate decision.

6.4  Property listings and IDX information

Listing information on this website is provided in part through Internet Data Exchange (IDX) feeds and other third-party sources. All listing information is deemed reliable but is not guaranteed and should be independently verified. Properties are subject to prior sale, change, or withdrawal without notice. Square footage, lot size, room dimensions, taxes, HOA and CDD fees, flood zone designations, school assignments, permits, and zoning are provided by third parties and may be inaccurate. Nothing on this website constitutes an offer to sell or a solicitation to buy any property. Listings of other brokerages are marked as required by the MLS.

6.5  Home valuation tools

Any home value estimate, market analysis, or valuation tool offered on this website is an estimate generated from available market data. It is not an appraisal, is not a guarantee of value, and should not be relied on as the basis for a purchase, sale, loan, or tax decision. Only a licensed appraiser can provide an appraisal.

6.6  Fair Housing and equal opportunity

We are committed to the letter and spirit of U.S. policy for the achievement of equal housing opportunity throughout the nation. We comply with the federal Fair Housing Act, the Americans with Disabilities Act, the Florida Fair Housing Act, and all applicable state and local fair housing laws. We do not discriminate on the basis of race, color, religion, sex, sexual orientation, gender identity, disability, familial status, national origin, or any other class protected by law.

6.7  Accounts and registration

If you create an account to save searches or favorite properties, you agree to provide accurate information, to keep your password confidential, and to notify us promptly of any unauthorized use. You are responsible for all activity under your account. We may suspend or terminate an account at any time for any reason, including violation of these Terms.

6.8  Acceptable use

You agree not to:

• Use any robot, spider, scraper, or other automated means to access, copy, index, or harvest listing data or any part of the Services
• Copy, republish, redistribute, or create derivative works from listing data or site content except for your personal, non-commercial use in identifying properties you may be interested in
• Reverse engineer, disassemble, or attempt to gain unauthorized access to any part of the Services or their systems
• Submit false, misleading, or fraudulent information, or impersonate another person
• Upload viruses, malware, or any code intended to disrupt or damage the Services
• Use the Services to send spam or unlawful, harassing, defamatory, obscene, or discriminatory content
• Use the Services for any purpose that violates federal, state, or local law, MLS rules, or fair housing law

6.9  Your submissions

If you submit a review, testimonial, photo, comment, or other content to us or about us, you grant The Pretty House Team a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and display that content in our marketing, on our website, and on our social media, with attribution as you provided it. You represent that you own or have the right to submit the content and that it does not infringe anyone else’s rights. Do not send us confidential information you do not want us to use.

6.10  Consent to communications

By providing your telephone number and submitting a form or otherwise requesting information, you agree that The Pretty House Team and its agents may contact you by phone, email, and — if you have opted in — text message at the number and address you provide, including with automated technology, regarding your inquiry and our real estate services. Consent to receive marketing calls or texts is not a condition of purchasing any property or service. Message and data rates may apply. You may revoke consent at any time by replying STOP to a text, using the unsubscribe link in an email, or asking us directly to stop contacting you. See Section 3 for full SMS details.

6.11  Intellectual property

All content on this website — including text, photographs, video, graphics, logos, and page design, but excluding third-party listing data and third-party marks — is owned by The Pretty House Team or its licensors and is protected by copyright and trademark law. “The Pretty House Team” and our logos are our marks. Realtor® and MLS® are registered marks of their respective owners. Charles Rutenberg Realty’s marks belong to Charles Rutenberg Realty. You may not use any of these marks without written permission.

Copyright complaints (DMCA). If you believe content on this site infringes your copyright, send a written notice containing the information required by 17 U.S.C. § 512(c)(3) to our designated agent at Amanda Lebiszczak, Pretty House Team – Amanda Lebiszczak, 1545 Belcher Road, Clearwater, FL 33764, (727) 655-9324, amanda@prettyhouseteam.com. We will respond as required by law and may remove the material and terminate repeat infringers.

6.12  Third-party links and services

The Services may link to or embed third-party websites, tools, and content, including MLS search, mapping, mortgage calculators, video platforms, and review services. We do not control and are not responsible for those third parties, their content, their accuracy, or their privacy practices. Links are provided for convenience and do not imply endorsement.

6.13  Disclaimer of warranties

THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY LISTING OR OTHER INFORMATION IS ACCURATE, COMPLETE, OR CURRENT.

6.14  Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE PRETTY HOUSE TEAM, ITS MEMBERS, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, WHETHER BASED IN CONTRACT, TORT, STATUTE, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00). SOME JURISDICTIONS, INCLUDING CALIFORNIA, DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU. 6.15  Indemnification

You agree to indemnify and hold harmless The Pretty House Team, Charles Rutenberg Realty, and their respective agents and affiliates from any claim, demand, loss, or expense, including reasonable attorneys’ fees, arising from your violation of these Terms, your misuse of the Services, or your violation of any law or third-party right.

6.16  Dispute resolution and governing law

Before filing any claim, you agree to contact us and attempt in good faith to resolve the dispute informally for at least 30 days. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Pinellas County, Florida, and you consent to personal jurisdiction and venue there. Nothing in this section prevents either party from bringing an individual claim in small claims court, and nothing in these Terms limits any non-waivable rights you may have under the laws of your home state, including California.

6.17  Accessibility

We are working to keep this website accessible to people with disabilities and to comply with applicable accessibility standards. If you have difficulty using any part of this site, or need assistance with any property or service, contact us using the information below and we will work with you to provide the information you need through another means.

6.18  General

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a sale or transfer of our business. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Services and supersede any prior understandings on that subject. Section headings are for convenience only.
